QUÉBEC DANSE PORTAL

 

Agreement between the Regroupement québécois de la danse (RQD) and the users of the Québec Danse portal
The following Terms of Use constitute a contractual agreement between you and the RQD regarding your access to and use of the Québec Danse portal. By submitting content for publication or by publishing content on the Québec Danse portal, you declare that you have read, understood, and accepted these Terms. You agree to comply with any and all applicable laws and regulations, and if you do not, you will not use this website.

Administration and moderation of the Québec Danse portal
The Québec Danse portal is administered by the RQD. Its target audience is made up of its members and, more generally, the professional dance community as a whole as well as anyone who is interested in dance. The Portal is both a hub of information and resources for dance professionals and a tool for promoting the discipline.

The Québec Danse portal allows all of its users (members and non-members of the RQD) to submit content for publication on the Agenda de la danse and Bulletin board via online forms. This content is subject to RQD moderation.

Active members of the RQD can directly publish content on the Bulletin and News feed boards via their Member area. This content is subject to RQD moderation. Active members can also fill out and modify content published in their Membership Directory profile (photos, videos, biography, contact info, links to social media, etc.).

Member area
Active members of the RQD possess a password-protected Member area that allows them to publish content on the Québec Danse portal (Agenda de la danse, Bulletin board, News feed, Membership Directory profile) and access exclusive content produced by the RQD. It is the responsibility of each member of the RQD to provide true and current information on their profile and to preserve the confidentiality of their password. An individual member’s email address will only be published on their profile and made visible to all users of the Québec Danse portal if the member gives prior authorization to the RQD to display this information.

It is possible for a member to renew their RQD membership via their Member area. In the event of the de-registration, suspension, or withdrawal of a member, membership fees will not be refunded, in compliance with the RQD general rules currently in force.

Members are held responsible for any activity that takes place in their Member area and are responsible for logging off at the end of each session. The RQD is not responsible or liable for identity theft. If you believe that another person is using your account, you agree to inform the RQD of this as soon as possible. Members who have lost their password can request it in the Connexion section of the Québec Danse portal.

Publication times
Certain functions of the Québec Danse portal allow users to submit content for publication via online forms. Publication times on the Québec Danse portal vary from board to board. Users should allow for up to 48 hours for the posting of their listings on the Bulletin board and the Agenda de la danse. Publication times are subject to modification without prior notice, and in such cases, dates will be posted on the Québec Danse portal.

Managing publications
The RQD reserves the right to remove, at its sole discretion, any content that violates the present Terms of Use or that it deems inappropriate, even if it is well understood that the content published by internet users is their own.

Hyperlinks to other sites
The Québec Danse portal contains hyperlinks to other sites. The RQD provides these hyperlinks for your convenience. Hyperlinks may not be interpreted as constituting an approval or endorsement of their content on the part of the RQD. The RQD is not responsible or liable for the content of third-party sites, the links they contain, or any changes or updates that are made to them, and it makes no warranty regarding them.

Users (members and non-members) who publish or submit content may add hyperlinks to third party sites, insofar as their content is connected to the subjects under discussion. The RQD is not responsible or liable for the content of these third-party sites. The RQD reserves the right to deactivate, at its sole discretion, any hyperlink that it deems inappropriate. No advertising will be tolerated.

Intellectual property
It is the responsibility of each user (members and non-members) of the Québec Danse portal to not violate any intellectual property rights, including copyright. By publishing or submitting content, users guarantee that the material and intellectual property of the content belongs to them, or that they have obtained the rights to the material and intellectual property of the content. Each user guarantees that the content they publish contains no defamatory remarks or obscenities, and does not violate the right to privacy or image rights of a third party. In cases where publication does not abide by the Terms of Use, the RQD may remove content without prior notice.

Content published or shared on the Québec Danse portal is protected by Canadian and international intellectual property laws. In addition to copyrights held by the RQD, copyrights may also be held by third parties.

Toile-mémoire de la danse au Québec iconographic archive [1895-2000]
The iconographic archival materials available on the Québec Danse portal relating to the Toile-mémoire and not part of the public domain are subject to licencing rights. The RQD has devoted a sustained effort to find right-holders holding rights to any of these iconographic archival materials. The RQD invites anyone who feels their rights have not been respected to contact the RQD at info@quebecdanse.org in order to indicate their connection to the materials in question.

Credits and captions on the Québec Danse portal
Any image, photo, or video published on the Québec Danse portal should be accompanied by a photo credit containing the name of the photographer or videographer, the name of any person appearing in the photo, the name of the show or event depicted, the name of the choreographer or artistic company, the name of the producer if need be, as well as the year the photo was taken. In the Agenda de la danse, it is the responsibility of users (members and non-members) who publish or submit content to provide this information in the “Légende / crédits photos” field provided for such purpose in the online form.

Termination
The previous Terms notwithstanding, the RQD reserves the right to terminate, at any time, without cause and without notice, and at its sole discretion, the present Terms of Use and/or the right to browse or use the Québec Danse portal or any parts and functions of the same.

Liability release
You acknowledge and agree that your use of the Québec Danse portal is at your own risk and that all elements published, transmitted, or disseminated via the Québec Danse portal are provided on an “as is” basis. The RQD, its members, its partners, as well as their respective directors, administrators, employees, or representatives, make no warranty and assume no liability regarding, including and without limiting the generality of the foregoing, the use and functioning of the Québec Danse portal, any element published, transmitted, or disseminated, viruses, errors and omissions, interruption or restriction of access, malicious attack or non-authorized use on the Québec Danse portal which may occur.

The RQD, its partners, as well as their respective directors, administrators, employees, or representatives, assume no liability for any consequences, losses, damages, or harm of any kind whatsoever directly or indirectly resulting from or relating to the use of the Québec Danse portal and the services, personal information, and content (texts, images, graphics, video, music, and others) that are published, transmitted, or made available thereon.

Applicable law and court of competent jurisdiction
The Terms of Use of the Québec Danse portal and the relationship between the User and the RQD are subject to the laws and regulations applicable in the province of Québec, Canada. The Users (members and non-members) give their consent to all litigation and claims resulting from or relating to the interpretation, application, carrying out, entry into force, or effects of the present Terms of Use being subject to the courts having competent jurisdiction in the judicial district of Montréal, province of Québec, Canada.

Declarations
By using the Québec Danse portal, you agree to indemnify and hold harmless the RQD, its members, its partners, as well as their respective directors, administrators, employees, or representatives, from and against any and all litigation and claims addressed to the same resulting from or related to a) your use of the Québec Danse portal, b) any material published, transmitted, or disseminated via the Québec Danse portal, or c) any failure to abide by any of the present Terms of Use.

You solemnly affirm that you are totally competent and able to agree to the present clauses, conditions, obligations, affirmations, assertions, and guarantees defined by the present Terms of Use; and to apply and abide by the Terms of Use.

SOCIAL MEDIA

By making social media part of its communications toolbox, the RQD has at its command a supplementary means of communication allowing exchange, collaboration, and interaction. Thus, it is able to reach its members and the dance community more broadly in a direct and effective way. The RQD’s active presence on social media allows it to:

  • Promote dance.
  • Disseminate information about its activities and positions.
  • Contribute to its members’ visibility and outreach.
  • Facilitate the sharing of diverse content in order to better understand key issues in the sector or major cultural issues.
  • Inform the dance community about matters that could aid them in their work or improve their working conditions.

Moderation
The RQD manages and curates its social media pages, including its Facebook, Instagram, Twitter, YouTube, and Vimeo accounts.

The RQD is not able to share the content published by its members on social media in its entirety. The RQD strives to provide equal treatment to those of its members present on social media, while at the same time curating its social media accounts in line with a communications strategy adapted to each platform.

The Québec Danse portal remains the hub of information dissemination and must thus be considered as the official source. RQD publications link back very frequently to the site and internet users will be invited to refer to it as much as possible.

The RQD follows social media accounts that it deems relevant to its mandate. Following an internet user’s Facebook, Instagram, Twitter, YouTube, or Vimeo does not signify that the RQD endorses or supports the internet user’s remarks or publications, and this is the case even when it concerns one of its members or even an organization of which it is a member. The use of the retweet, share, or “Like” functions does not signify that the RQD endorses the content in question.

Some RQD employees have accounts on various social media platforms. Despite their professional affiliation with the RQD, the opinions and points of view that they express do not represent the official position of the RQD. Rather, they must be considered as instances of personal expression on the part of individual citizens.

Netiquette
The RQD encourages internet users to freely express their ideas in a respectful manner by showing public-mindedness and courtesy, so as to feed into a constructive discussion. The RQD invites internet users to comment on RQD publications, so long as they take care to not stray from the subject and to not publish the same content repeatedly.

Adding hyperlinks to other sites is authorized, insofar as the content is connected to the subjects under discussion. The RQD is not responsible or liable for the content of these sites. The RQD reserves the right to deactivate, at its sole discretion, any external link that it deems inappropriate. No advertising will be tolerated.

The publication and posting of any document (texts, photos, sound or video recordings, etc.) must respect intellectual property rights, including copyright. By publishing content, internet users agree that the material and intellectual property of the content belongs to them, or that they have obtained the rights to the material and intellectual property of the content.

The RQD encourages respect for the right to privacy. Internet users who wish to post photos or videos must have the consent of the persons concerned.

The RQD cannot tolerate the publication of comments or content that go against the values of the organization or that do not abide by the present netiquette. It thus reserves the right to remove, at its sole discretion, any comment or content created or shared on its social media pages that it deems inappropriate, even if it is well understood that the content published by internet users is their own.

Editorial line
At its base, the RQD internet community is connected by its interest in dance and culture. Its expectation is to receive news concerning RQD programs and activities, information that could aid artists in their work or improve their working conditions, and, more broadly, information on major cultural issues. It is important to curate its social network by offering original content while also passing on community content. Internet users expect the RQD to share and retransmit news about its network. It is by disseminating community publications that the community is able to grow.

Here are the types of information that can be disseminated, transmitted, or quoted:

  • RQD actions, statements, or publications (letter, article, press release, study, etc.).
  • Attendance at an event in which the RQD is participating or collaborating.
  • Information on training programs offered by the RQD.
  • News relating to members (launches, prizes, events, discounts, news).
  • News or publications of interest coming from the media, partners, or recognized organizations.
  • Bulletin board listings (calls for project proposals, job offers, etc.).
  • Dance events in the Agenda de la danse.
  • All manner of content provided that it contributes to a given issue.
